Today we are going to chat about Minnesota’s foreclosure and guidelines. First, each state can be a little bit different with foreclosure guidelines and laws. In the state of Minnesota, the rules are very lenient so that the property owner has more options. This gives the house owner the opportunity to redeem the property and get back to current on their mortgage.
So, obviously, the first piece of this course is falling behind in your mortgage. The house owner will be receiving tons of calls from the lender collection unit demanding payment and intimidating you. Ultimately, they are trying to worry you.
Every short sale that we have, ultimately the home owners miss payments. There are lots of tactics that the lenders have, several that are proven to succeed. The lender is obviously trying to get as much cash from the property owner as feasible.
After that, when you are 3 or four months behind schedule, you will be served documents and given you a sheriff sale date. Frequently that is about 6 months from the first payment that you missed. Lots of people believe that is the conclusion of the process. However, that is not true. In the state of Minnesota we are given another six months to save the property. Most lenders will work with a short sale in the redemption stage as well.
There is lots of time to do a short sale in the state of Minnesota. Even if you are nine months late it is still possible to complete a short sale.
The final date of the redemption phase is not negotiable. When you are in the redemption period there is no way to extend that time line. If you get a bid before the sheriff sale there are a lot of times that the lender will lengthen that so they do not have to go through the foeclosreu procedure.
